The United States Department of Justice has said today that it supports the ruling by a federal judge that the entire Affordable Care Act should be overturned. This is a major shift in the Trump administration’s standing on the Obama-based federal healthcare treatment law.
“The Department of Justice has determined that the district court’s judgment should be affirmed,” wrote three department lawyers in a letter submitted Monday to the U.S. Court of Appeals for the Fifth Circuit. This court is now considering the case. “Because the United States is not urging that any portion of the district court’s judgment be reversed, the government intends to file a brief on the appellees’ schedule.
“The Department of Justice has determined that the district court’s comprehensive opinion came to the correct conclusion and will support it on appeal,” said Kerri Kupec, the Justice Department spokeswoman.
At this time the Affordable Care Act has officially been ruled as unconstitutional by the federal court.
